Home Affairs Cabinet Secretary Kithure Kindiki revealed on March 21 that the government had written to TikTok saying it was not satisfied with their level of compliance with Kenyan laws.

Speaking before the Public Petitions Committee, Kindiki noted that ByteDance Limited, the Chinese multibillion-dollar company that owns TikTok, would have to respond to the letter or his ministry would take administrative action.

However, he noted that it would be premature to ban TikTok in Kenya at this time without taking into account the views of the owners and those affected.

He added that extensive analysis would need to be done to assess the risks and benefits of taking a drastic action such as a local ban on the platform.

He added that extensive analysis would need to be done to assess the risks and benefits of taking a drastic action such as a local ban on the platform.

“I don’t think we can say that the dangers outweigh the benefits. It’s a little premature. We should develop a program where we have an evidence-based policy to assess whether the risks outweigh the benefits,” he noted.

“It will be premature. What we are doing now is a procedural requirement of the law. Whatever action the government takes is an administrative action and there is a procedure including hearing those affected.”

In response, Kindiki explained that all measures are being considered in his ministry and a comprehensive analysis will be conducted before any action is taken.

“Our ministry coordinates the country’s cyber security program. Going forward, we should invest in internal security and defense measures, but we need both military and internal security expertise to ensure the fourth component of our country’s defense, which is cyberspace. The potential to harm a country through cyberspace is great, ” he added.

“Let’s not just look at quick fixes, but let’s have a long-term comprehensive plan and help the country not ban TikTok.”
